These Terms govern your use of the Recoup platform. By creating an account or submitting a case, you agree to them.

What Recoup is

Recoup is a victim intake and litigation-funding platform. Recoup is not a law firm, does not employ your attorney, and does not provide legal advice. Legal services connected to a claim, where applicable, are provided by independent counsel affiliated with Recoup, under a separate engagement.

No guaranteed outcome

Submitting a case, being assessed as a “Strong Case,” joining as a claimant, or contributing to the litigation fund does not guarantee any legal outcome, recovery amount, or timeline. Litigation and collective action outcomes depend on facts outside our control, including whether responsible parties can be identified and whether they hold recoverable assets.

Accuracy of information

You represent that the information and evidence you submit is truthful and belongs to you or that you have the right to submit it. Knowingly submitting false information may result in removal from a collective action.

Litigation-fund contributions

Contributions fund the cost of investigation, forensic analysis, and legal action. They are not a payment for a promised outcome and are generally non-refundable once confirmed, except as required by law or as separately agreed in writing. Any recovery from a judgment or settlement is distributed according to the court's order, the settlement agreement, and the Claimant Agreement, never according to contribution tier.

Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Limitation of liability

To the maximum extent permitted by law, Recoup is not liable for indirect, incidental, or consequential damages arising from your use of the platform, including the outcome of any legal proceeding.

Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active claimants by email.
